Terms governing Bright AI Limited subscriptions, credits, and AI generation services

Introduction

These Terms of Service ("Terms") govern access to and use of the Bright AI Limited website, AI image and video generation tools, subscriptions, credit packages, account features, and related digital services (collectively, the "Service").

Bright AI Limited is a limited company registered in Hong Kong. By creating an account, purchasing credits or a subscription, or using the Service, you agree to these Terms.

Eligibility and Accounts

  • You must be at least 18 years old and legally able to enter into a binding agreement.
  • You must provide accurate information and keep it current.
  • You are responsible for activity under your account and for protecting your credentials.
  • You may not sell, transfer, or share an account in a way that creates security, payment, or policy risk.

Service Description and Delivery

The Service allows customers to create and edit digital media using text prompts, images, videos, and supported AI generation workflows. Features may include text-to-video, image-to-video, video editing, and image generation.

Paid credits are normally delivered to the customer's account immediately after successful payment. Generation availability, processing time, output format, duration, resolution, and model controls vary by feature and system demand.

Bright AI Limited may use third-party infrastructure and AI model providers to deliver the Service. Bright AI Limited does not claim ownership of third-party models and is not affiliated with a model provider unless expressly stated.

Subscriptions, Credits, and Billing

  • Plans may be billed monthly, annually, or as a one-time credit purchase.
  • The price, credit allocation, billing interval, and expiry period are displayed before checkout.
  • Credits are service usage units with no cash value and cannot be transferred, exchanged, or redeemed for cash.
  • Free and daily check-in credits may have separate limits and expiry periods.
  • Taxes may be added where required.

Subscriptions automatically renew at the end of each billing period until canceled. By subscribing, you authorize recurring charges to the selected payment method.

Cancellation

You may cancel a subscription through the billing or customer portal at any time. Cancellation stops future renewal charges. For standard end-of-period cancellation, paid access and remaining subscription credits continue until the end of the current paid billing period, when they expire unless the checkout terms state otherwise. If you request immediate termination, access ends and remaining subscription credits expire immediately.

Cancellation does not create a right to a pro-rated refund. Eligible initial annual subscriptions may qualify for the stated 14-day guarantee, and completely unused one-time credit packages may qualify when requested within 48 hours. User Content and Intellectual Property

You retain your rights in content you upload and in eligible generated outputs to the extent permitted by applicable law and third-party model terms.

You grant Bright AI Limited a limited license to host, process, transmit, moderate, and store user content only as reasonably necessary to provide, secure, support, and comply with legal obligations relating to the Service.

You must have the rights and permissions required for uploaded content, prompts, reference media, personal likenesses, trademarks, and generated uses. We do not promise that generated content is unique, non-infringing, or suitable for every commercial purpose. Commercial use remains subject to applicable law, these Terms, and any model-specific restrictions shown in the Service.

We own the Service software, website, branding, documentation, and platform materials, excluding user content and third-party materials.

Acceptable Use

You must comply with our Acceptable Use Policy and Content Moderation Policy. Prohibited uses include illegal content, sexual or adult content, child exploitation, fraud, deceptive deepfakes, intellectual-property infringement, unlawful violence, hate, and attempts to bypass safeguards.

We may reject requests, remove outputs, restrict features, or suspend accounts when reasonably necessary for safety, payment security, legal compliance, or policy enforcement.

Availability and Changes

AI outputs may contain errors, artifacts, or unexpected results. The Service is provided on an "as is" and "as available" basis. We may modify models, pricing for future purchases, credit costs, limits, or features. Material changes affecting an active subscription will be communicated where required.

Disclaimer and Liability

To the maximum extent permitted by law, Bright AI Limited disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the maximum extent permitted by law, Bright AI Limited is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill.

Our aggregate liability for claims relating to the Service will not exceed the amount paid by the customer to Bright AI Limited during the three months preceding the event giving rise to the claim. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

Suspension and Termination

We may suspend or terminate access for non-payment, fraud, security risk, illegal activity, material policy violations, sanctions restrictions, or attempts to harm the Service or other users.

Upon termination, rights to use the Service end. Provisions that by their nature should survive will remain in effect.

Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Subject to any mandatory consumer rights, the courts of Hong Kong have non-exclusive jurisdiction over disputes arising from these Terms or the Service.

Before starting formal proceedings, please contact us and allow 5 business days for an initial response and a reasonable opportunity to resolve the issue.

Trade and Geographic Restrictions

You may not use the Service where doing so would violate applicable sanctions, export-control laws, or other trade restrictions. Access may be restricted for prohibited jurisdictions or sanctioned persons.

Changes to These Terms

We may update these Terms. The current version and effective date will remain available on this page. Where required, we will provide notice of material changes.
